    Gran, a California resident, wrote the following in her own handwriting while alone at her home: "I hereby give my niece Lori my pigeons at my death, along with the eastern half of Real Acre, my downtown building. My nephew Tim is to have the western half of Real Acre." Gran then dated and signed the document. She did not show it to anyone. She later died. After her death another signed hand writing was found which said only, "Should my will be found invalid, I leave Real Acre to my husband." This writing had also never been known to exist.

    After reading the reading of the will Tim realized that there was no way to enter the western half of Real Acre except by using the only driveway on the property, which was in the eastern half. He brought suit against Gran's executor claiming reimbursement of any money he may have to spend on creating a road into the western half of Real Acre. Gran's husband, a California resident, brought suit claiming ownership of Real Acre and of Gran's pigeons.
