Man needs peace. Man needs justice. Man needs human rights. Man desires to live with prestige and dignity. Man needs the rights to property. Man needs rights of worship to his God as per his religious beliefs. Man needs protection from culprits and anti social people. Man needs independence in his thoughts and beliefs. He treats him as the custodian of his family and the assets. Man needs justice for his work and treats him as an equal partner of the state. He desires to enjoy his rights as a free citizen of the country. If he is devoid of his human rights as a citizen, he takes the shelter of the court to fight against injustice. It is because the government officials treat them as powerful people, who are the custodians of the law of the land.
In the Twenty-first century the numbers of court-cases are increasing each day. The bureaucracy in all developing countries is manipulating the law of the land as per their whims. The court cases are delayed for decades and the sufferers are suffering because courts are lethargic in disposing of the cases at a snail’s speed. Court cases are not disposed of as there is no time-limit for the cases. The poor petitioner suffers a great deal. Even the courts take four decades to award justice for murders cases. For example, Dr. LN Mishra, the former Railways Minister of India was killed by miscreants and the final judgement was delivered in 2015 after 40 years.
The manuscript on ‘Justice and Peace’ is a small step for ensuring peace to people, governments, countries and the world. Peace could be achieved by thoughts and deeds by individuals. The State and the justice system can assure justice to the sufferers provided these institutions are clean, non-corrupt and efficient.
The present manuscript entitled “Justice and Peace” has included eight chapters depicting Justice is Peace, Judges must save the Nation, Landmark Judgements, Justice is Expensive, State Laws in India, Justice and Governance, Judiciary Corruption and in the eighth chapter we have opined that ‘World Peace is Possible’. In short, the Justice system should ensure quick delivery of judgements to protect the people of the world from torture and mental agony.
They simply need a safer world to live in with human rights, justice, safety and peace in life. Could the Courts award judgement in a time-bound period before the petitioner’s death warrant? The cases should not continue for generations. A case started by a Petitioner (who is no more now) and could not be decided within her life period, should be declared as winner to award peace to her soul after death. Who is responsible for delay?
